Lloyd Maynard: Successful Interim Mandatory Injunction
Lloyd Maynard (Call – 2010) of Forum Chambers appeared for RAC Motoring Services in the High Court King’s Bench Division on Wednesday 16 November 2022. He was successful in obtaining an interim mandatory injunction against First Choice Recovery Group Ltd (“FCRG”), a sub-contractor of the RAC, to deliver up a number of vehicles over which FCRG had asserted a lien.
Lloyd persuaded His Honour Judge Gargan (sitting as a Judge of the High Court) that he could have a high degree of assurance that RAC was likely to succeed with a claim for return of the vehicles as bailee. The injunction was crucial in ending a stand-off between RAC and its sub-contractor, returning a number of vehicles to their owners.
